Our website reflects a curated, knowledgeable, and nurturing style, focusing on specialty shrubs like rare Camellias, fragrant Azaleas, and structured Boxwood. We communicate as trusted guides in your gardening journey.

2. User Obligations and Account Responsibility

• Provide accurate, current, and complete information during account registration and checkout.

• Ensure the shipping address you provide is accurate and accessible for delivery. We are not liable for delays or losses due to incorrect addresses.

3. Product & Service Description

We specialize in premium, living shrubs. Our collections include:

• Specialty Varieties: Azaleas (Bicolor, Fragrant, Reblooming, Orange), Camellias (for Espalier, Hedges, Double Flowers, Cold Hardy, Fall Blooming, Pink, Red), Dwarf Gardenias, Boxwood, Hydrangeas, Lavender.
• Rare & Limited Plants: Items listed under the “Rare” menu category are unique, one-of-a-kind specimens.

We make every effort to display product colors and details accurately. However, slight variations may occur due to monitor settings and the living nature of plants.

4. Orders & Payment Terms

4.1 Order Process

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline orders for any reason, including limitations on quantity, inaccuracies in product or pricing information, or issues identified by our credit and fraud avoidance processes.

4.2 Pricing & Payment Methods

All prices are in US Dollars (USD). We accept the following payment methods: Visa, MasterCard, JCB, and PayPal. Payment is processed securely at the time of order.

4.3 Shipping & Delivery

• Order Processing: All orders are meticulously prepared within 1-2 business days.
• Shipping Methods:
  • Standard Shipping ($12.95): Via DHL or FedEx. Delivery typically within 10-15 business days after shipment.
  • Free Shipping: For orders over $50, shipped via EMS. Delivery typically within 15-25 business days after shipment.
• Shipping Regions: We ship globally. Deliveries to some parts of Asia and remote regions may be excluded or subject to additional logistics review and delays.
• You will receive tracking information once your order ships. Delivery dates are estimates, not guarantees.

5. Returns, Exchanges & Guarantees

5.1 Standard Returns Policy

• Return Window: 15 days from the date of delivery.
• Condition: Items must be in original, resalable condition with all packaging and tags intact.
• Process: You must contact us first at [email protected] to initiate a return and receive a Return Merchandise Authorization (RMA) number. Unauthorized returns will not be accepted.
• Costs: The customer is responsible for return shipping costs unless the return is due to our error.
• Refunds: Issued to the original payment method within 7-10 business days after we receive and inspect the return.

5.2 Non-Returnable Items

The following are considered final sale due to their living and unique nature:

• All plants listed under the “Rare” category.
• Any custom or special-order plants requiring non-standard preparation.
• Note: Rare plants are covered by a separate Plant Health Guarantee for shipping-related viability issues. Contact us immediately upon receipt if there is a problem.

5.3 Damaged or Incorrect Items

Contact us within 48 hours of delivery with your order number and clear photos. We will arrange a replacement or refund and cover all associated shipping costs.

6. Intellectual Property

All content on this website—including text, graphics, logos, images, and product descriptions—is the property of Foxtail Plant Shop or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

7. Limitation of Liability

Foxtail Plant Shop will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the site or any products purchased, including but not limited to loss of profits, data, or business opportunity.

Our total liability for any claim related to your order shall not exceed the total purchase price of the items in that order. This limitation applies to the fullest extent permitted by law.
